1. Acceptance of Terms
By using agilepress.net, you agree to these terms. If you do not agree, please do not use our website or services. These terms apply to all visitors, users, and clients.
2. Services & Methodology
AgilePress Solutions LLC specializes in minimalist WordPress development, WPO (Web Performance Optimization), and agile maintenance.
- Agile Approach: We work based on the “MVP” (Minimum Viable Product) and Pareto (80/20) philosophy. We prioritize function and speed. Features not explicitly agreed upon in the project scope are not included.
- Third-Party Tools: We build upon the WordPress Core and open-source ecosystems. We are not responsible for changes made by third-party providers (e.g., WordPress.org updates, plugin developers, or hosting changes) that may affect your site after delivery.
3. Intellectual Property
- Your Content: You retain full ownership of all content (text, images, data) you provide to us for your website.
- Our Code: Upon full payment, we grant you a perpetual, non-exclusive license to use the code and design created for your project. However, AgilePress Solutions LLC retains the right to reuse generic code snippets, libraries, or our internal “Toolkit” for other projects.
4. Payments & Refunds
- Project Commencement: Development work begins only after the agreed initial deposit has been received.
- Refunds: Due to the nature of digital services and time invested, deposits are generally non-refundable once work has commenced. Specific terms regarding milestones and payments will be outlined in your individual project proposal/contract.
5. Limitation of Liability
To the fullest extent permitted by law, AgilePress Solutions LLC shall not be liable for any indirect, incidental, or consequential damages resulting from:
- Errors or downtime caused by hosting providers (e.g., Cloudways, Rocket.net).
- Security breaches resulting from weak passwords or compromised user devices.
- Loss of data (we always recommend maintaining your own backups).
Our total liability for any claim arising out of our services is limited to the amount you paid us for the specific service in question.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New Mexico, without regard to its conflict of law provisions.
7. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any significant changes by updating the “Last Updated” date at the bottom of this page.
